LEO’s use of deadly force resulting in serious injury was reasonable as a matter of law when officer shot a fleeing suspect as the suspect ignored orders to stop and removed a gun from his waistband. The suspect threw the gun away and 2-4 seconds later the officer fired three rounds at the suspect.  The court ruled as a matter of law the LEO’s actions were reasonable because given the motion a reasonable office could have believed the suspect was turning to fire the weapon at the officer.
