Because¬†objectively reasonable police officers could have relied in good faith on the search warrant, the evidence found as a result of the warrant was not excluded under the exclusionary rule even though the probable cause determination by the judge who issued the warrant was defective.¬† The officer who sought the warrant did not have a “reckless disregard for the truth” nor was the warrant application so lacking in indicia of probable cause on it’s face as to put them on notice.¬† So the officers could rely in good faith on the judge’s finding of probable cause even though it was subsequently held to be in error.
